You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
4. Platform Services
Nature of Platform: Apna Consultant is a neutral venue. We are not a party to any agreements entered into between Clients and Consultants. We do not employ, endorse, or recommend any specific Consultant or Client.
User Interactions: You are solely responsible for your interactions with other users. We are not responsible for the conduct of any user. We encourage you to conduct your own due diligence before engaging with other users.
No Guarantees: We make no guarantees regarding the quality, suitability, reliability, or outcome of any services provided by Consultants or requirements posted by Clients.
5. User Conduct and Responsibilities
You agree not to use the Services for any unlawful purpose or in any way that could harm, disable, overburden, or impair the Services. You agree not to post or transmit any content that is fraudulent, misleading, defamatory, obscene, or infringes on any third-party rights.
6. Content Ownership and Licensing
User Content: You retain ownership of any intellectual property rights that you hold in the content you submit to the Platform ("User Content"). By submitting User Content, you grant Apna Consultant a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the Services.
Platform Content: The Services and all materials therein, including software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, and photographs ("Platform Content"), and all Intellectual Property Rights related thereto, are the exclusive property of Apna Consultant and its licensors.
7. Fees and Payments
Access to and use of certain basic features of Apna Consultant are currently free. If Apna Consultant introduces any new services that require fees, we will notify you in advance, and you will have the option to accept or decline those services. Any financial transactions between Clients and Consultants are handled directly between them, and Apna Consultant is not a party to such transactions and assumes no liability for them.
8. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, APNA CONSULTANT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; OR (III) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
10. Indemnification
You agree to indemnify and hold harmless Apna Consultant, its officers, directors, employees, and agents, from and against any claims, disputes, demands, liabilities, damages, losses, and costs and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with (i) your access to or use of the Services or Content, (ii) your User Content, or (iii) your violation of these Terms.
11. Termination
We may terminate or suspend your access to the Services, in our sole discretion, at any time and without notice to you, for any reason, including if you violate these Terms. Upon termination, all licenses and rights granted to you in these Terms will immediately cease.
12. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.
